A second federal judge has ruled in favor of Governor Edwards’s executive order that restricts bars to only take-out and delivery service. Eleven bar owners in the Acadiana area claim they were shut down without constitutional due process.
But Judge Robert Summerhays in Lafayette ruled last night there is a real and substantial relation between the restrictions on bars and the state’s effort to control the spread of COVID-19.
Edwards testified in the Lafayette case and said the state has seen a reduction in coronavirus cases since bars were prohibited from allowing on-site consumption.
A federal judge in New Orleans also ruled in favor of Governor Edwards. The plaintiffs, in that case, were 10 bar owners in southeast Louisiana. In both cases, it was determined the governor has the ability to order bars closed in a public health emergency.
